THE RIGHT OF WITHDRAWAL
The internet sales of our products are identified as distance contracts, therefore, governed according to the D. lgs n. 206/05 (artt. from 50 to 68) which regulates the matter of distance contracts, that is done outside of business premises. If the Customer is a consumer (ie a person who buys goods for purposes not related to his professional activity, or does the purchase by indicating in the order form to Elettronew Web Market s.r.l. a reference to VAT) has the right to withdraw from the purchase contract for any reason, without explanation and without any penalty. To exercise this right, the Customer must send Elettronew Web Market s.r.l. a written communication in this sense, and within 14 working days from the date of receipt of the goods also provide the shipment of the above goods purchased at the office of the ELETTRONEW Web Market s.r.l. The notice of withdrawal must be sent by registered letter with acknowledgment of receipt, addressed to ELETTRONEW Web Market s.r.l. Via Comunale Castagna,16, Casoria 80026 (NA). Once you have sent the above communication of withdrawal,the customer Is obliged to return the goods within and not later than 30 days from the date of the stamps post by registered mail. the customer must take care to return the goods indicating on the package your data such as name, surname, address and telephone number, and order number to reference.
The right of withdrawal is however subject to the following conditions:
the law applies to product purchased in its entirety;
it is not possible to exercise withdrawal only on part of the product purchased (eg: accessories, software, attachments, etc...);
the law does not apply to audiovisual products or to sealed software items (including those annexed to hardware material), once opened;
the purchased goods must be returned undamaged and in the original packaging, complete in all its parts (including any documentation and accessory equipment: manuals, cables, etc.);
according to the law, the shipping costs are the responsibility of the Customer;
the shipment until the certificate of receipt in our warehouse is under the full responsibility of the Customer;
in case of damage of the goods during transport, Elettronew Web Market s.r.l. give notice to the Customer of the happened one (within the next business day following receipt of the goods in their stores), to enable a timely complaint against the courier chosen by him and obtain reimbursement of the value of the asset (if insured); in this case, the product will be returned, with shipping costs charged to the Customer, while canceling the request for withdrawal;
Elettronew Web Market s.r.l is not responsible in any way for damage or theft/loss of goods returned with not insured shipments;
on his arrival at the warehouse, the product will be examined to assess any damages or tampering not caused by transport.
The refund will be made within 14 days, if possible with the same payment instrument used at the time of purchase, or alternatively by Bank Transfer.The right of withdrawal lapses totally, for lack of the essential integrity of the property (the packaging and/or its contents), in cases where Elettronew Web Market s.r.l finds:
The lack of the original internal/external package;
the absence of integral elements of the product (accessories, cables, manuals, parts, ...);
damage to the product for causes different from its transportation or for exceeding the time limits provided by law for reasons not arising from the Elettronew Web Market s.r.l.
In the case of forfeiture of the right of withdrawal, Elettronew Web Market s.r.l will return to the sender the acquired good, debiting to same expenses of shipment.The right of withdrawal by the Customer does not apply in the case in which the withdrawal of the goods has been withdrawn and paid in a shop (Pick&Pay) as, in this case, the transaction turns into a booking turning into a purchase at the time of issue of the receipt or the invoice of the shop.
Therefore it can not be regarded as a transaction concluded online or mail-order sales and the relationship you enjoyed with the owner of the shop affiliate in normal commercial premises.
NOTE: The articles contained on the site that will need to be ordered on order of the customer will not be able to exercise the right of withdrawal.
ATTENTION: IT IS NOT POSSIBLE TO EXERCISE THE RIGHT OF WITHDRAWAL ON CABLES ALREADY CUT. AFTER FIVE MINUTES FROM THE CONCLUSION OF THE ORDER CONTAINING CABLE, THE CABLE WILL STILL BE PAID AND SHIPPED REGARDLESS OF THE CANCELLATION OF THE ORDER BY THE CUSTOMER.
APPLICABLE LAW AND COMPETENT COURT:
The present General terms and Conditions and the relationship between Elettronew Web Market s.r.l and the consumer are governed by the law of the Italian Republic. Any dispute concerning, arising out of or related to these General Conditions of Contract will be referred to the jurisdiction of the courts of the registered office of Elettronew Web Market s.r.l., who is elected to all intents and purposes the Civil Court of Naples, in derogation from the law.BILLING

The sale is exempt from the obligation of billing pursuant to art.22, paragraph 1, point (1) of the PRESIDENTIAL decree 633/72. This means that it is not obligatory on our part to issue an invoice but we need to make a note of the sale in the registry of the entries that is compiled every night at the close of the case, so if you want to receive the invoice, it is important to specify at the time of the order (in the notes via email) as it will not be possible to apply for it.
